RESUMO: O presente trabalho tem como principal objetivo analisar a possibilidade da responsabilização civil da genitora, em situações que haja a falsa imputação de paternidade. Para tanto, utiliza-se o método dedutivo, por meio de pesquisa bibliográfica, artigos e análise jurisprudencial. De início será realizado um estudo sobre o instituto da paternidade perante a legislação brasileira, conceito, formas e modalidades. Em seguida, passamos à análise da distinção entre filhos legítimos e ilegítimos no anterior Código Civil de 1916 e posteriormente a exclusão desta discriminação com o advento da Constituição Federal de 1988 e Lei Oficiosa de Paternidade (nº 8.560/92). Em momento posterior passamos a análise sobre o cabimento da reparação por danos morais decorrente das relações familiares, com ênfase na falsa imputação de paternidade. Por fim, examinaremos o posicionamento jurisprudencial favorável ao cabimento de reparação de danos morais, frente à ofensa.

ABSTRACT: The main objective of this work is to analyze the possibility of civil liability of the mother, in situations where there is a false imputation of paternity. For that, the deductive method is used, through bibliographic research, articles and jurisprudential analysis. At first, a study will be carried out on the institute of paternity under Brazilian legislation, concept, forms and modalities. Next, we analyze the distinction between legitimate and illegitimate children in the previous Civil Code of 1916 and later the exclusion of this discrimination with the advent of the Federal Constitution of 1988 and the Official Paternity Law (nº 8.560/92). At a later time, we analyzed the appropriateness of reparation for moral damages resulting from family relationships, with emphasis on the false imputation of paternity. Finally, we will examine the jurisprudential position favorable to the compensation of moral damages, in the face of the offense.
