RESUMO: O presente trabalho objetivo estudar os regimes de bens e seus efeitos nas sucessões por morte do cônjuge ou companheiro. A mutabilidade do regime de bens durante a vigência do casamento. Doação. Testamento. Analisar o instituto das cláusulas restritivas em doações, como a cláusula de incomunicabilidade e de reversão. Seu alcance e sua eficiência na proteção do bem doado não acabar entregue a quem não é desejado. As imposições para o uso dessas cláusulas em diferentes situações, na doação e no testamento. Análise da mudança do art. 1790 e seus efeitos nas sucessões.

ABSTRACT: The present work aims to study the property regimes and their effects on successions for the death of the spouse or partner. The mutability of the property regime during the marriage. Donation. Testament. Analyze the institute of restrictive clauses in donation, such as the incommunicability and reversal clause. Its scope and its efficiency in protecting the donated good does not end up delivered to those who are not wanted.
