RESUMO: Inicialmente, vale aqui instituir que a alienação parental consiste em uma conduta abusiva que advém da figura do agente alienador como forma de promover o afastamento da criança com um dos seus genitores. Levando-se em consideração os diversos problemas que esta prática pode desencadear foi promulgada a Lei da Alienação Parental (BRASIL, 2010) com a finalidade de tentar coibir ou reprimir este ato que tanto repercute de maneira negativa sob a perspectiva daquele que se encontra em desenvolvimento. Nesse sentido, verifica-se que diversos casos são submetidos cotidianamente ao crivo do Poder Judiciário sob a alegação da ocorrência da alienação parental, mas, em várias ocasiões, o esforço da parte em ter reconhecida esta conduta muitas vezes não se mostra suficiente, eis que os elementos probatórios carreados nos autos acabam se mostrando insuficiente para a comprovação das alegações, de acordo com o que será exposto no decorrer deste Trabalho de Conclusão de Curso.

ABSTRACT: Initially, it is worth noting here that parental alienation is an abusive conduct that comes from the figure of the alienating agent as a way to promote the removal of the child with one of its parents. Taking into account the various problems that this practice can trigger, the Parental Alienation Law (BRASIL, 2010) was enacted with the purpose of trying to curb or repress this act that negatively affects the perspective of the one who is developing. . In this sense, it appears that several cases are subjected daily to the scrutiny of the judiciary on the grounds of the occurrence of parental alienation, but, on several occasions, the effort of the party to have recognized this conduct is often not enough, behold The evidential elements carried out in the records turn out to be insufficient to prove the allegations, according to what will be exposed during the course conclusion paper.
