RESUMO: O presente trabalho, terá como propósito, analisar a forma com que as alterações legislativas previdenciárias trazidas ao longo dos anos impactaram o benefício previdenciário da Pensão por Morte no Regime Geral da Previdência Social, dando enfoque nas mudanças introduzidas pela Emenda Constitucional nº 103, de 13 de novembro de 2019 que implementou a reforma previdenciária sob a Lei 8.213/1991. Para tanto, busca-se primeiramente apresentar os princípios que regem a Seguridade Social no Brasil, bem como a Previdência Social, responsável pelo pagamento do benefício da pensão por morte. Ainda, apresenta a evolução histórica do referido benefício que culminou na reforma de 2019, além de estabelecer as principais noções a respeito de seu conceito e requisitos para a concessão. Por fim, será analisado a existência de conflitos entre as novas normas implementadas pela reforma, com os princípios fundantes da Previdência Social, bem como se atentará a analisar se, com as respectivas mudanças promovidas pela Reforma da Previdência de 2019, há uma forma efetiva de proteção social ou um retrocesso no que diz respeito aos direitos e garantias dos futuros beneficiários da pensão por morte.

ABSTRACT: The purpose of the present work is to analyze the way in which the social security legislative changes brought over the years, impacted the social security benefit of the death pension. Focusing on the changes introduced by Constitutional Amendment No. 103, of November 13, 2019, which implemented the pension reform under Law 8,213 / 1991. To this end, we seek first to present the principles that govern Social Security in Brazil, as well as Social Security, responsible for the payment of the death pension benefit. Still, it presents the historical evolution of the referred benefit that culminated in the 2019 reform, in addition to establishing the main notions regarding its concept and fit. Finally, there will be an analysis of the existence or not of conflicts between the new rules implemented by the reform, with the founding principles of Social Security, as well as an attempt to analyze whether, with the respective changes promoted by the 2019 Social Security Reform, there is a effective form of social protection or a setback, as to the rights and guarantees of future death pension beneficiaries.
