RESUMO: O presente trabalho aborda a Proteção de dados como um direito fundamental na Constituição Federal. A principal finalidade desta pesquisa é identificar se esta proteção de dados do indivíduo se adequa dentro do artigo 5° §2°, decorrentes dos princípios adotados pela Constituição Federal, aqueles que acabarão se tornando princípios fundamentais devido à necessidade da sociedade ao longo dos anos. Ou então se adequa como a proposta da PEC 17/2019 que é a realização de uma emenda à Constituição Federal, que torna a proteção de dados pessoais um direito fundamental. Concomitantemente examina o posicionamento dos tribunais e entendimentos jurisprudenciais sobre o tema abordado, através de pesquisas exploratórias e pesquisas bibliográficas, a fim de responder a problematização apresentada. Diante do cenário da sociedade da tecnologia era evidente que necessitaríamos de uma garantia fundamentada legalmente sobre a Proteção de Dados.

ABSTRACT: The present work addresses Data Protection as a fundamental right in the Federal Constitution. The main purpose of this research is to identify whether this protection of individual data is adequate within article 5 § 2, arising from the principles adopted by the Federal Constitution, those that will eventually become fundamental principles due to the need of society over the years. Or else it suits the proposal of PEC 17/2019, which is an amendment to the Federal Constitution, which makes the protection of personal data a fundamental right. At the same time, it examines the positioning of the courts and jurisprudential understandings on the subject addressed, through exploratory research and bibliographic research, in order to respond to the presented problematization. Given the scenario of the technology society, it was evident that we would need a legally based guarantee on Data Protection.
