RESUMO: O presente trabalho visa o estudo de alguns dos Decretos Presidenciais que
dispõem sobre a alteração de regras e maior flexibilização para aquisição, cadastro,
registro, posse e porte de armas de fogo, acessórios e munições, dentre outros
assuntos, editados ao longo da legislatura do atual presidente da República, sob o
enfoque do alcance do Poder Regulamentar conferido ao Poder Executivo pela
Constituição Federal. Mesmo sob a égide de um Estado Democrático de Direito, as
recentes regulamentações, movidas por interesses políticos e econômicos, têm
ultrapassado as limitações constitucionais previstas ao Poder Executivo, inovando
na ordem jurídica e afrontando princípios sensíveis, como o da separação dos
poderes, e basilares, como o princípio da legalidade. Os decretos editados, que
possuem o condão constitucional de regulamentar a lei, precisam ter profunda
harmonia com o texto legal, devendo total respeito ao dispositivo que objetivam
normatizar.

ABRSTRACT: The present work aims to study some of the Presidential Decrees that provide for the
change of rules and greater flexibility for the acquisition, registration, possession and
carrying of firearms, accessories and ammunition, among other subjects, edited
throughout the legislature of the current President of the Republic, under the focus of
the scope of the Regulatory Branch granted to the Executive Branch by the Federal
Constitution. Even under the aegis of a Democratic State of Law, recent regulations,
driven by political and economic interests, have surpassed the constitutional
limitations foreseen for the Executive Branch, innovating in the legal system and
facing sensitive principles such as the separation of branches and foundations as the
principle of legality. The edited decrees, which have the constitutional power to
regulate the law, need to be in deep harmony with the legal text, with full respect for
the device that it aims to regulate.
