RESUMO: O presente trabalho tem o intuito de analisar o ordenamento jurídico brasileiro no que diz respeito ao direito dos animais, observando as mudanças jurídicas da proteção dos animais não humanos no Brasil, desde os primórdios até a legislação atualmente vigente no país, bem como fazer uma comparação com a legislação vigente em outros países, verificando a possibilidade de enquadrar o animal nãohumano como individuo dotado de dignidade própria, como sujeito do direito, posto a salvo da crueldade. O trabalho indica diversos Diplomas Legais vigentes que regulamentam o direito dos animais, inclusive diplomas legais que prevêem cominação penal a quem os violente, entretanto também aponta o crescente aumento de práticas cruéis a animais, demonstrando assim, que ainda há diversas
lacunas a serem preenchidas que possam garantir o direitos dos animais. Neste contexto, buscou-se discutir se as penalidades impostas são adequadas e também se há necessidade de um aprofundamento dos estudos nesse campo, que vise a garantia do direito dos animais. Esses e outros questionamentos são abordados no trabalho, buscando demonstrar o longo caminho que ainda há de se percorrer em prol da efetividade do direito dos animais.

ABSTRACT: This paper aims to analyze the Brazilian legal system regarding animal rights, observing the legal evolution of the protection of non-human animals in Brazil, from the beginning to the current legislation in the country, as well as make a comparison. with the legislation in force in other countries, verifying the possibility of framing the non-human animal as an individual with its own dignity, as a subject of the right to dignified existence, safe from cruelty. The work points to a number of existing legal diplomas that regulate animal rights, including legal diplomas providing for criminal prosecution of those who violate them, but also points to the increasing number of cruel animal practices, thus demonstrating that there are still several gaps to be filled that guarantee the rights of animals. In this context, we sought to discuss whether the penalties imposed are appropriate and also whether there is a need for further studies in this field, aimed at guaranteeing animal rights. These and other questions
are addressed in the paper, seeking to demonstrate the long way to go in favor of the effectiveness of animal rights.
