RESUMO: O presente trabalho objetiva apresentar o cumprimento da medida socioeducativa de internação por jovens do sexo feminino, evidenciando os avanços introduzidos a legislação em matéria de direitos infanto-juvenis, desde a Doutrina da Situação irregular até o avanço na política de atendimento com adoção da Doutrina da Proteção Integral, estabelecida na Constituição Federal, de 1988, e no Estatuto da Criança e do Adolescente, de 1990, a qual reconhece as crianças e adolescentes como cidadãos e pressupõe que os mesmos desfrutem de direitos e obrigações compatíveis com sua peculiar condição de desenvolvimento. Embora formalmente previsto na legislação brasileira, esse princípio não tem se traduzido na prática estatal diante das recorrentes violações de direitos fundamentais e discriminação de gênero perpetradas em face das adolescentes inseridas no sistema privativo de liberdade.

ABSTRACT: The present study aims to present the fulfillment of the socio-educational measure of hospitalization by young women, highlighting the advances made in the legislation on the rights of children and adolescents, from the Doctrine of the Irregular Situation to the advance in the care policy with the adoption of the Doctrine of the Integral Protection, established in the Federal Constitution of 1988, and in the 1990 Statute of the Child and Adolescent, which recognizes children and adolescents as citizens and assumes that they enjoy rights and obligations compatible with their peculiar condition of development. Although formally established in Brazilian law, this principle has not translated into state practice in the face of the recurrent violations of fundamental rights and gender discrimination perpetrated against the adolescents included in the custodial system.
