RESUMO: Devido as grandes mudanças ocorridas no meio familiar, a evolução da sociedade levou o ordenamento jurídico a proteger e garantir os direitos fundamentais a estes novos arranjos familiares, estes passaram a ser constituídos pelo afeto, não somente pelo laço consanguíneo. A Constituição Federal de 1998 trouxe esta inovação, como também o Código Civil recepcionou de forma ainda tímida em alguns dispositivos expressos. A inseminação caseira vem sendo realizada por casais, principalmente nas uniões homoafetivas femininas, é usada esta técnica pelo fato de não possuir condições financeiras para custear o procedimento em clínica especializada, assim sendo realizado sem qualquer amparo por um profissional de saúde. A ausência de norma legal traz insegurança para aqueles que se submetem a este método, apesar da precariedade das normas referentes a união homoafetiva e da inseminação artificial caseira, as soluções decorrentes a estes assuntos são sanadas através de Provimento ou Resoluções.

ABSTRACT: Due to the great changes that occurred in the family environment, the evolution of society led the legal system to protect and guarantee the fundamental rights to these new family arrangements, these began to be constituted by affection, not only by the conblood bond. The Federal Constitution of 1998 brought this innovation, as well as the Civil Code received in a still timid way in some express devices. Home insemination has been performed by couples, especially in female homoaffective unions, this technique is used because it does not have financial conditions to fund the procedure in a specialized clinic, thus being performed without any support by a health professional. The absence of a legal norm brings insecurity to those who submit to this method, despite the precariousness of the norms related to homoaffective union and homemade artificial insemination, the solutions arising from these issues are addressed through Provision or Resolutions.
