RESUMO: O tema deste breve estudo é um dos mais debatidos na mídia atual, pois aborda a nova qualificadora penal, incluída pela Lei n° 13.104/2015, a qual tipificou o homicídio qualificado por razões de gênero, o feminicídio. O questionamento base para o desenvolvimento da monografia foi: o presente estudo nos permite verificar qual a importância da nova lei de feminicídio para a proteção das mulheres? Ainda cabe salientar acerca da efetividade e redução dos índices de violência contra mulheres no Brasil. Para tal, este estudo aborda a relação de autoridade do homem sobre a mulher inserida pelo patriarcalismo e de que maneira isso afetou a violência de gênero que vitima mulheres até hoje. Conforme será demonstrado, o aspecto mais cruel da violência contra a mulher é o feminicídio, sendo assim, a necessária inovação legislativa, apesar de representar um progresso importante na luta pela proteção feminina, foi objeto de inúmeras opiniões por parte de doutrinadores e operadores do direito, razão pela qual é necessário apresentar a qualificadora e analisar a eficácia da criminalização do feminicídio como providência de combate à violência de gênero contra a mulher. Para tanto, o trabalho utilizou-se de pesquisa bibliográfica, artigos científicos e jurisprudência.

ABSTRACT: The theme of this brief study is one of the most debated in the current media, as it addresses the new criminal qualifier, included by Law No. 13,104 / 2015, which typified gender-based homicide, feminicide. The basic question for the development of the monograph was: does the present study allow us to verify the importance of the new feminicide law for the protection of women? It is still worth mentioning the effectiveness and reduction of violence against women in Brazil. To this end, it addresses the relationship of authority of men over women inserted by patriarchalism and how it affected the gender violence that victimizes women until today. As will be demonstrated, the most cruel aspect of violence against women is feminicide, thus being the necessary legislative innovation, despite representing an important progress in the fight for the protection of women, it was the object of innumerable opinions on the part of legal professors and operators, reason why which it is necessary to present the qualifier and analyze the effectiveness of the criminalization of feminicide as a measure to combat gender-based violence against women. For that, the work used bibliographic research, scientific articles and jurisprudence.
