RESUMO: A presente pesquisa tende a apresentar elementos que permitem a análise do Holodomor sob a perspectiva dos elementos constitutivos do crime de genocídio, a partir das normativas que descrevem e proíbem esse tipo de crime e, desta forma, provocando reflexões sobre o tema. Como premissa, considerando o objetivo principal, o trabalho será baseado nas diretrizes descritas no Estatuto de Roma do Tribunal Penal Internacional e outros documentos e normas que serão analisados, junto com a análise de artigos, teses, livros e outros periódicos publicados sobre o tema, estes servirão de norte para a conceituação do crime de Genocídio, que por sua vez proporcionará a compreensão das causas e consequências do Holodomor. Especificamente a pesquisa esteve à volta das diretrizes do TPI, que entrou em vigor em 2002 com objetivo de prevenir e punir esses tipos de ações, mas com a ressalva de punir somente crimes que aconteceram e acontecerão a partir dessa data, por esse motivo o Holodomor até a presente data não foi julgado.

ABSTRACT: The current research tends to present elements that favor an analysis of the Holodomor under the aspect of the characterization of a genocide, provoking reflections on the theme from the perspective of regulations that describe and prohibit this type of crime. As a premise, considering the main goal, the work will be based on the guidelines from the International Criminal Court (ICC) and other documents and norms that will be analyzed, along with the analysis of articles, theses, books and other periodicals published on the subject, these will serve as a north to the typification of the crime of Genocide, which in turn will provide an understanding of the causes and consequences of the Holodomor.
Specifically, the research was around the guidelines of the ICC, which came into force in 2002 with the goal of preventing and punishing these types of actions, but with the exception of punishing only crimes that have happened and will happen from this date on, for this reason the Holodomor to date has not been judged.
