RESUMO: O presente trabalho científico-acadêmico apresenta uma reflexão sintética dos contratos inteligentes autoexecutáveis à luz da teoria geral dos contratos no direito brasileiro. Os operadores do direito necessitam estreitar o conhecimento técnicojurídico, uma vez que o direito das obrigações assiste a incursão da tecnologia computacional na sua principal fonte, os contratos. No corpo do conhecimento, a presente monografia tem a presunção de fornecer subsídios cognitivos para investigar a validade, eficácia e efeitos jurídicos dos smart contracts, como instrumentos
legítimos na manifestação de vontades que se perfazem no mundo dos bits, ou como ferramentas tecnológicas. No que respeita a metodologia adotada, lançou-se mão da pesquisa bibliográfica que constituiu a base do conhecimento por meio da doutrina jurídica, livros técnicos, revistas especializadas, artigos científicos, tanto em bibliotecas físicas, quanto em sítios internet. À vista disso, aplicou-se a abordagem estática com relação às características distintivas, aos dados relevantes, ao objeto e aos requisitos de identificação. Como resultado, traçou-se um paralelo entre a tecnologia e a teoria geral dos contratos, retratando as opiniões dos autores estudados e os elementos constitutivos do negócio jurídico na doutrina do direito. Da
mesma maneira, revelou-se o interesse na autoexecução contratual, tanto na esfera privada, quanto na esfera pública, sem a necessidade de inovação legal ao estágio atual que se encontra a tecnologia dos contratos inteligentes autoexecutáveis. Por fim, o presente trabalho perpassa por regimes jurídicos que permitem a aplicação dos contratos autoexecutáveis e, do mesmo modo, vislumbram-se oportunidades e a necessidade do estreitamento cognitivo dessa tecnologia computacional pelos operadores do direito.

ABSTRACT: This scientific-academic paper presents a synthetic ponder of smart contracts in the light of the general theory of contracts in the brazilian law. The law operators need to narrow down the technical-juridical knowledge, once the law of obligations aid the computational technology incursion in it’s own source, the contracts. In the matter of
knowledge, the present monography has the presumption to supply cognitive subsidies to investigate the validity, efficacy and juridical effects of smart contracts, as legitimate instruments of the manifestation of wills that take part in the bit world, or as technological tools. With regard to the adopted methodology, bibliographic research was used and it constituted the knowledge base through juridical doctrine, technical books, specialized journals and scientific articles found both on physical and online
libraries. With that in mind, static approach was applied in relation to distinctive characteristics, to the relevant data, to the object and to the identification requirements. As a result, a parallel between the technology and the general theory of contracts was created, portraying opinions of studied authors and constitutive elements in the juridical business in the doctrine of law. Likewise, the interest in self execution of contracts was
revealed, both in the private and public spheres, without the necessity of legal innovation at the current stage in which the technology of smart contracts is. Lastly, the present paper pervades through juridical regimes which allow the application of self-executing contracts and, in the same way, opportunities and the necessity of the cognitive narrowing of the computational technology through the law operatives are glimpsed.
