RESUMO: O tráfico de animais silvestres é considerado a terceira maior atividade ilegal do mundo, sendo responsável por movimentar anualmente valores incalculáveis. No Brasil, as consequências desse comércio tem levado a devastação do meio ambiente, com a consequente extinção de diversas espécies da fauna, estimando-se ainda, que a cada 10 animais traficados, apenas 1 sobreviva diante da crueldade utilizada em tal prática ilegal. Deste modo, considerando a relevância do tema em âmbito social e ambiental, a presente pesquisa tem por objetivo, analisar os aspectos do crime de tráfico de animais silvestres no Brasil e suas características, além de analisar as áreas do direito envolvidas em tal temática e as dificuldades encontradas no combate a este crime. Também serão analisadas a forma de fiscalização e repressão, além das legislações vigentes de proteção ao meio ambiente e repressão aos crimes ambientais, através da metodologia utilizada na presente pesquisa, que será descritiva com base em pesquisas bibliográficas. Para tanto, pode-se concluir que a legislação e os órgãos executivos envolvidos, necessitam de atualizações e investimentos financeiros em diversas áreas, pois estes tem se mostrado ineficazes no combate ao comércio ilegal de animais, demonstrando carência em diversos aspectos. Ademais, sabe-se que existem outros problemas que necessitam ser solucionados, como a pobreza, a desigualdade social, a educação, e a emergência em estudos e programas de prevenção à respeito desta temática, que busquem diminuir o interesse da população em adquirir esses animais e exercer este tipo de atividade, concientizando à todos a respeito das graves consequências causadas por esse comércio ilegal.

ABSTRACT: Wild animal trafficking is considered the third largest illegal activity in the world, being responsible for moving incalculable amounts annually. In Brazil, the consequences of this trade have led to environmental devastation, with the consequent extinction of several species of fauna. It is also estimated that for every 10 animals trafficked, only 1 survives due to the cruelty used in such illegal practice. Thus, considering the relevance of the theme in the social and environmental scope, this research aims to analyze the aspects of the crime of wild animal trafficking in Brazil and its characteristics, in addition to analyzing the areas of law involved in this theme and the difficulties encountered in combating this crime. The form of inspection and repression will also be analyzed, in addition to the current legislation on environmental protection and repression of environmental crimes, through the methodology used in this research, which will be descriptive based on bibliographic research. Therefore, it can be concluded that the legislation and the executive bodies involved, need updates and financial investments in several areas, as these have been shown to be ineffective in combating the illegal trade in animals, showing a lack in several aspects. Furthermore, it is known that there are other problems that need to be resolved, such as poverty, social inequality, education, and the emergence of studies and prevention programs on this topic, which seek to reduce the population’s interest in acquiring these animals. and carry out this type of activity, making everyone aware of the serious consequences caused by this illegal trade.
