RESUMO: O presente estudo tem como tema a função social da propriedade e a aplicação do Imposto sobre a Propriedade Predial e Territorial Urbana (IPTU) progressivo no tempo no Município de Curitiba/PR. A pesquisa foi realizada com a finalidade de identificar a aplicação do IPTU progressivo no tempo pelo município, para exigir que o proprietário cumpra com a função social da propriedade. O objetivo da presente pesquisa é no sentido e averiguar a realização da função social da propriedade e a utilização do IPTU progressivo no tempo identificando a legislação pertinente a tema delimitado ao município de Curitiba. A presente pesquisa trata-se de um estudo descritivo, bibliográfico e de levantamento. O trabalho esta dividido em dois capítulos: no primeiro é abordada a função social da propriedade e apresentação dos dispositivos constitucionais no Brasil nos seus aspectos históricos, sendo que o capitulo inicia com a busca de definição e conceitos de propriedade e na sequência aborda seus aspectos históricos, já no segundo capitulo é abordado o cumprimento da função social da propriedade estabelecidas no Plano Diretor do município de Curitiba/PR, bem como é levantado a legislação existente no município inerente ao tema estudado. As análises apresentados neste estudo indicam inobservância a dispositivos legais quanto ao controle da função social da propriedade, não sendo utilizado do mecanismo do IPTU progressivo no tempo.

ABSTRACT: The present study has as its theme the social function of property and the application of the Tax on Urban Property and Territorial Urban (IPTU) progressive in time in the city of Curitiba / PR. The research emerged with the purpose of identifying the application of the progressive IPTU over time by the municipality to demand that the owner comply with the social function of the property. The objective of the present research is in the sense of verifying the realization of the social function of the property and the use of IPTU progressive over time, identifying the pertinent legislation to a theme delimited to the municipality of Curitiba. This research is a descriptive, bibliographic and survey study. The work is divided into two chapters: in the first, the social function of ownership and presentation of constitutional provisions in Brazil in its historical aspects are addressed, the chapter beginning with the definition and concepts of property and then addresses its historical aspects, already in the the second chapter deals with the fulfillment of the social function of the property established in the Master Plan of the municipality of Curitiba / PR, as well as the existing legislation in the municipality inherent to the studied theme is raised. The analyzes presented in this study indicate non-compliance with the legal provisions regarding the control of the social function of the property, not using the mechanism of IPTU progressive over time.
