RESUMO: É cada vez mais comum ouvirmos sobre crimes de abuso sexual contra crianças e adolescentes no Brasil. Com base nesse fato, é importante estudarmos e entendermos como são tratados casos como estes, e, principalmente entendermos a necessidade da correta captação de depoimentos de vítimas, uma vez que há grandes chances de revitimização e até mesmo a possibilidade de causar novos traumas. O objetivo do depoimento especial é impedir a revitimização da criança e adolescente vítima de abuso sexual. Na presente monografia será abordado como é possivel identificar o outor através das provas e como estas são classsificadas no ordenamento juríco brasileiro atual, além disso, será apresentado o conteito de depoimento especial desde o surgimento do conceito até o objetivo e funcionalidade nos dias atuais. Primeiramente versa saber sobre a origem do termo abuso e como acontece em familias brasileiras vez que em muitos dos casos o agressor convive com a criança e adolescente vítima e testemunha. Por seguinte será apresentada à definição de provas e como são apresentadas ao processo para que haja efetiva investigação e possibilidade de localização do agressor com base nos depoimentos e provas arroladas. Posteriormente se dará a abordagem do tema principal desde o tratamento das vítimas, à efetiva aplicação da lei. Por fim, estudo de caso concreto em situações embasadas em estatisticas e como ocorre a oitiva junto aos profissionais. Desse modo o presente estudo tem como objetivo a análise da importância do depoimento especial e a forma como é tratado junto às vítimas.

ABSTRACT: It is increasingly common to hear about crimes of sexual abuse against children and adolescents in Brazil. Based on this fact, it is important to study and understand how cases of necessity such as these are treated, and, mainly, to understand the need to capture testimonies from victims, since there are great chances of revictimization, even the possibility of new cases. The purpose of the special testimony is to prevent the re-victimization of children and adolescents who are victims of sexual abuse. The photograph will be considered relevant in the sense that, in addition to identifying or identifying the Brazilian concept of classifications, the content of special testimony will be possible from the characteristic of the concept to the functionality in the present day. It is about knowing about the origin of the term abuse and how it happens in Brazilian families since in many cases the aggressor lives with the child and adolescent victim and witness. Because the definition of evidence is presented and how they are carried out in the process so that there is an investigation and the possibility of locating the aggressor based on the testimonies and evidence listed. Subsequently, the main theme of the treatment of victims will be approached, to the effectiveness of law enforcement. Finally, a concrete case study in situations based on statistics and how the hearing with professionals occurs. Thus, the present study aims to analyze the importance of the testimony as it is treated with the victims and the way it is treated with the victims.
