RESUMO: É importante ressaltar que em 2015 foi promulgada a Lei 13.105, delimitando, assim, novos contornos para a norma processual cível. Dentre os diversos destaques, pode ser observada a tutela de urgência antecipada, que será desmembrado com maior afinco nesta pesquisa acadêmica. Diane disso, a base do estudo reside na análise a respeito dos requisitos que viabilizam a concessão da medida, além de diversos outros aspectos que se encontram associados à temática levantada, como, por exemplo, a questão do perigo que versa a respeito da irreversibilidade da medida, além do provável direito do autor. Levando-se em consideração as diversas particularidades pertinentes à matéria, a problemática desta pesquisa acadêmica reside justamente no fato de que se a mera existência a respeito do perigo da irreversibilidade da antecipação da tutela de urgência é fator suficiente para que tal não seja objeto de concessão nos autos do processo? Esta dúvida será sanada no decorrer desta pesquisa acadêmica.

ABSTRACT: It is important to note that Law 13,105 was enacted in 2015, thus delimiting new outlines for the civil procedural rule. Among the several highlights, there can be observed the urgent guardianship in advance, which will be dismembered with greater diligence in this academic research. Therefore, the basis of the study lies in the analysis of the requirements that make the granting of the measure feasible, in addition to several other aspects that are associated with the theme raised, such as, for example, the question of the danger that concerns the irreversibility of the measure, in addition to the probable author’s right. Taking into account the various particularities pertinent to the matter, the problem of this academic research lies precisely in the fact that if the mere existence regarding the danger of irreversibility of the anticipation of urgent protection is a sufficient factor for this not to be the object of concession in the case file? This doubt will be resolved in the course of this academic research.
