RESUMO: O tema abordado no presente trabalho é a Alienação Parental no Direito, ou seja, os
seus aspectos jurídicos, baseado nos princípios que norteiam o direito de família e
também a legislação vigente referente ao tema. O objetivo da pesquisa é verificar o
que é a alienação parental e quais as consequências jurídicas aplicadas ao alienador.
Para isso, será necessário conceituar a alienação parental, apresentar a legislação
aplicável, analisando sua lei específica, para no fim verificar quais as consequências
jurídicas aplicáveis demonstrando o posicionamento jurisprudencial no estado do
Paraná. A pesquisa foi realizada a partir de uma revisão bibliográfica, buscando por
autores renomados do direito de Família e também a busca por artigos científicos
publicados nos meios acadêmicos e site do IBDFAM sobre o tema. Após encontrar
um material muito vasto foi realizada a leitura dos sumários dos livros em busca dos
tópicos que mais se adequavam às pretensões dessa autora. Diante de tudo que foi
lido e estudado para a realização deste trabalho, observou-se que a alienação
parental é uma conduta prejudicial à saúde mental dos envolvidos e principalmente
prejudicial aos relacionamentos inter-familiares, de modo que é importante estudar
quais as consequências jurídicas previstas em Lei para o alienador. A busca do
conhecimento é imprescindível para que se alcance o bem-estar da criança e do
adolescente, razão pela qual o tema é de fundamental importância, devido a imensa
quantidade de relacionamentos amoroso que chegam ao fim, sem que haja o cuidado
com a saúde mental dos filhos.
ABSTRACT: The theme addressed in this work is Parental Alienation in Law, that is, its legal
aspects, based on the principles that guide family law and also the current legislation
on the subject. The objective of the research is to verify what is parental alienation and
what are the legal consequences applied to the alienator. For this, it will be necessary
to conceptualize parental alienation, present the applicable legislation, analyzing its
specific law, in order to verify the applicable legal consequences demonstrating the
jurisprudential position in the state of Paraná. The research was carried out from a
bibliographic review, looking for renowned authors of Family Law and also the search
for scientific articles published in academic circles and the IBDFAM website on the
subject. After finding a vast amount of material, the book summaries were read in
search of the topics that best suited the author’s intentions. In view of everything that
has been read and studied for the accomplishment of this work, it was observed that
parental alienation is a conduct harmful to the mental health of those involved and
mainly harmful to inter-family relationships, so it is important to study what are the
expected legal consequences in Law for the alienator. The search for knowledge is
essential to achieve the well-being of children and adolescents, which is why the topic
is of fundamental importance, due to the immense amount of love relationships that
come to an end, without taking care of mental health. of children.
