RESUMO: O tema abordado no presente trabalho é o Inventário Extrajudicial, baseado na legislação e princípios que o possibilitam. O objetivo dessa pesquisa é verificar se há a possibilidade da realização do inventário extrajudicial mesmo com a presença de herdeiros menores de idade. Para isso serão estudados os requisitos para que tal procedimento aconteça, e como a legislação e a jurisprudência atuais tem se posicionado a respeito do tema. Esse trabalho foi realizado a partir de uma revisão bibliográfica em busca de autores renomados do Direito Civil Brasileiro, que dominam o tema. Além de pesquisa jurisprudencial atual sobre o Inventário Extrajudicial. Os autores, livros e jurisprudências foram selecionados a partir da revisão dos sumários dos livros, buscando aquilo que se adequava ao que era pretendido por esse trabalho e também foi buscado por livros e decisões mais atuais. A Lei 11.411/2007 trouxe modificações ao Código de Processo Civil e Código Civil passando a possibilitar o inventário na modalidade extrajudicial desde que preenchidos alguns requisitos. Será observado ainda se esses requisitos podem ser relativizados.
ABSTRACT: The topic addressed in the present work is the Extrajudicial Inventory, based on the legislation and principles that make it possible. The objective of this research is to verify if there is the possibility of carrying out the extrajudicial inventory even with the presence of minor. For this, the requirements for such a procedure will be studied, and how current legislation and jurisprudence has positioned itself on the subject. This work was carried out from a bibliographic review in search of renowned authors of Brazilian Civil Law, who dominate the subject. In addition to current jurisprudential research on the Extrajudicial Inventory. The authors, books and jurisprudence were selected from the review of the summaries of the books, looking for what suited what was intended by this work and was also searched for more current books and decisions. Law 11,411/2007 brought changes to the Code of Civil Procedure and Civil Code, allowing the inventory in the extrajudicial modality provided that certain requirements are met. It will also be observed whether these requirements can be relativized.
